NPC Deputies and CPPCC Members Deliberate Judicial Reports: Serving the Overall Interests and Adhering to Justice for the People
Two reports on the work of the Supreme People’s Court (SPC) and the Supreme People’s Procuratorate (SPP) were deliberated and discussed by deputies to the National People’s Congress (NPC) and members of the National Committee of the Chinese People’s Political Consultative Conference (CPPCC) attending the two sessions on March 9 and 10.
NPC deputies and CPPCC members said that the judicial reports delivered for deliberations this year were innovative and down-to-earth, which responded to social hot issues and concerns, presented an extraordinary year in China’s judicial process, and documented the progress on the rule of law in China.
Enforcing the law strictly to safeguard social harmony and stability
The rule of law guarantees the country’s long-term peace and stability. From severe punishment on all kinds of crimes to high-quality development of services, the judiciary authorities have made great efforts to maintain the social order and defend the safety of the masses.
The NPC deputy Dong Kaijun, president of the Anhui Higher People’s Court, said, “The judicial responsibility of serving the overall interests has promoted the implementation of decisions and arrangements made by the CPC Central Committee in the courts. A series of powerful and effective judicial measures have demonstrated the judicial organs’ commitment to serving the overall interests.”
In 2020, a total of 5,474 criminal cases were penalized for pandemic-related crimes. A total of 36,000 enterprises was helped in the resumption of activity and production, and a total of 35,053 criminal cases involving underworld crimes with 226,459 people was concluded. Zhao Zhengyong was sentenced to death with reprieve and life imprisonment, and Lai Xiaomin was sentenced and executed, demonstrating the Party Central Committee’s strength in cracking down on corruption.
With typical cases and concrete data, the reports enabled people to feel the visible and tangible fairness and justice.
“I am deeply impressed by the major cases mentioned in the reports. In recent years, the rights and security of people have been better guaranteed, which cannot be achieved without the efforts of the judicial organs,” said Tan Zeyong, an NPC deputy and secretary of the general Party branch of Nan Muqiao village, Tan Jiazhai Township, Mayang Miao Autonomous County, Hunan province. He mentioned that the settlement of 22,000 cases of corruption, bribery and dereliction of duty involving 26,000 people demonstrated the strong determination of the Party Central Committee to punish corruption. No place has been out of bounds in the fight against corruption and corruption must be severely punished. Tan stated that these cases would surely act as a great deterrent to those who committed corruption and bribery, helping create a clean and upright political environment.
In 2020, the judicial organs shouldered their responsibilities for helping enterprises of all kinds resume activity and production. According to the SPP work report, a total of 23,000 people was charged with crimes of damaging the legitimate rights of private enterprises, up 2.9 percent year-on-year.
“Protection of property rights is the basis for stimulating the vitality of market entities. For private enterprises, the protection of property rights, intellectual property rights and the legitimate rights of entrepreneurs is of great importance,” said Xu Guanju, an NPC deputy and chairman of Transfer Group. He hoped that the judicial departments could further create a good legal environment for the healthy development of private enterprises and crack down on illegal and criminal acts infringing on private enterprises.
Adhering to Justice for the People, and safeguarding the legitimate rights and interests of the people according to law
The vast majority of judicial cases are closely related to the masses. The settlement of these cases helps win the hearts and minds of the people and achieving fairness and justice.
“The judicial organs have been making efforts to safeguard the safety in people’s production and life, which is reflected in terms of the prevention and control of throwing objects from high altitude, the treatment of missing manhole covers, and the severe punishment of extortion crimes,” said He Hengyang, an NPC deputy and prosecutor-general of the Chongqing People’s Procuratorate. He stated that in order to effectively protect the legitimate rights and interests of the people, the judiciary authorities would adhere to the people-centered development philosophy and continue to make efforts to safeguard the people’s rights and interests in all aspects.
He said that being of one heart with the people was of great importance to handle the concerns and worries of the people.
“The Supreme People’s Court and the Supreme People’s Procuratorate have upheld fairness and justice, and carried forward the spirit of the rule of law through their vivid judicial practices, thus safeguarding national security, ensuring economic development and improving people’s livelihood,” said Wang Fengqiao, an NPC deputy and the director of Xingtai Vocational Education Teaching and Research Office. She pointed out that with the development of economy and society, the people’s diversified demands for justice were increasing. Therefore, smarter, more convenient and more efficient judicial services will be needed so as to enhance the people’s sense of gain, happiness and security.
The deputies to the NPC and members of the CPPCC National Committee have been deeply impressed by the solid achievements and highlights of the SPC and SPP work reports, which closely addressed social concerns and actively responded to the issues concerning the people’s livelihood.
“These remarkable achievements cannot be obtained without the hard work of judicial officials, which have reflected the ‘Justice for the People’ concept of rule of law,” said Li Shenglong, a member of the CPPCC National Committee and vice president of Chongqing No.1 Intermediate People’s Court.
Strengthening self-construction and safeguarding fairness and justice
The judiciary authorities must bear in mind that it takes a good blacksmith to make steel, and they should stay true to the mission under the supervision of the people.
Jiang Tianliang, an NPC deputy and associate professor of Hunan Xiangxi Vocational and Technical College for Nationalities, said that to promote the construction of the rule of law in China, judicial organs at all levels should strengthen their self-construction, fully implement judicial reform tasks, and build a professional team that has political awareness, faith, and obey the rules. They should try their best to make the people feel fairness and justice in every judicial case.
“At present, the rectification work of national political and legal education has started. The political and legal systems, including the courts and procuratorates, should fully implement the requirements of the Party Central Committee, punish criminals, solve difficult problems, and promote the establishment of rules and regulations,” Jiang said.
How to build a high-caliber and professional front-line team? “It would be a helpful and appropriate way to build complete and efficient judicial systems in order to enhance the effectiveness of the rule of law at this moment,” said Zhang Shuhua, a member of the CPPCC National Committee and director of Institute of Political Science of Chinese Academy of Social Sciences. He believed that it was necessary to make scientific use of judicial power and resources, and allocate more precious judicial resources to the grassroots, front-line judicial business, and front-line judges and prosecutors. He also suggested strongly supporting and caring for judges and prosecutors who have been conscientiously working in the front line all year round.
The judiciary is the last line of defense to safeguard social fairness and justice. The reports pointed out that in the follow-up work it was necessary to build an excellent team and implement the rectification work of team education.
“The ongoing work to rectify the national political and legal education should find the key to the problems and deal with them. Justice is the lifeline of the rule of law. Only by handling cases in accordance with the law and upholding fairness and justice, can the country make steady progress,” said Gao Zicheng, an NPC deputy and president of Beijing Lawyers Organization.
